29 CFR 1926.1412(d)(1)(iii): Air, hydraulic, and other pressurized lines for deterioration or leakage, particularly those which flex were not in normal operation. On or about January 2023, and at times prior to, employees operated a Terex RT 450 crane, that was not visually inspected by a competent person for apparent deficiencies such as but not limited to: hydraulic leakage was not in normal operations.

29 CFR 1926.1427(a): General requirements for operators. The employer did not ensure that each operator is trained, certified/ licensed, and evaluated in accordance with this section before operating any equipment covered under subpart CC, except for the equipment listed in paragraph (a)(2) of this section. On or about January 2023 and at times prior to, at this workplace an employee operated a Terex RT 450 crane, was not trained , certified , licensed or evaluated to operated the crane from the construction work site to a flatbed trailer for pickup and repairs.
