29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards:   Progressive Treatment Solutions, East St. Louis, IL: On or about 18 November 2022, the employer did not select needed personal protective equipment for employees cleaning the dry cure room with chlorine dioxide.  The employer selected only a half-mask respirator.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Progressive Treatment Solutions, East St. Louis, IL: On or about 18 November 2022, employees working the dry cure rooms were fit tested and required to wear half-mask, negative pressure respirators and were not medically evaluated to determine suitability for respirator usage.
