29 CFR 1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed: a) Production Floor: On or about , November 21, 2022, and at times prior, the employer exposed employees to caught-in hazards, in that the sprocket wheel and chain at the foam cutting table were not enclosed to protect employees from the ingoing pinch point while the employees are cutting foam.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) Warehouse Floor: On or about November 16, 2022 and at times prior, the employer exposed employees to struck-by hazards, in that the employer did not provide formal powered industrial vehicle operator training and evaluation to employees who operate the "Crown" LP 10,000 forklift (serial number 10109555).
