OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  On or about November 14, 2022, employees were exposed to fall hazards while working from a platform that was not designed and constructed to safely support personnel and was not attached to the forks to prevent falls to lower levels while the pallet was elevated by the forks of powered industrial vehicles. The employees were exposed to falls of about 6-8 feet to the surface below.

Cranes were not inspected for defects at intervals as defined in paragraph (j)(1)(ii) of this section or as specifically indicated, including observation during operation for any defects which might appear between regular inspections:  On or about November 22, 2022, the employer did not conduct frequent inspections (daily to monthly) of the top running double girder overhead cranes used on the Molding Floor, in the Furnace Dept. and the Machine Shop of the copper foundry. The cranes are used on a move flats, castings, ladles and molds in the copper foundry ranging in weights approximately 200 pounds up to 10-tons.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  On or about November 14, 2022, the employer did not report within 24 hours the in-patient hospitalization of an employee who received injuries to both right and left legs while at their workplace. OSHA was not notified of the injury and in-patient hospitalization until on or about November 22, 2022, during an opening conference with the employer as a result of an OSHA online complaint received.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  On or about November 22, 2022, the employer did not ensure powered industrial truck operators were given an evaluation at least once every three years. Employees operate power industrial vehicles on a daily basis and the facility has numerous slopes and inclines throughout the facility.
