OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees engaged in maintenance activities at 11002 Sapp Brothers Drive, Omaha, Nebraska on or about November 22, 2022, were exposed to a fall hazard in that the employees were not using fall protection when exposed to a fall of approximately 5 feet from the ground while working on a CATERPILLAR 627F Motor Scraper. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Train employees to recognize the dangers of accessing and working on top of mobile equipment above 4 feet without fall protection or guardrail device. 2) Develop work rules and disciplinary procedures prohibiting accessing and working on top of mobile equipment above 4 feet without using fall protection or a guardrail device. 3) Utilize a fall protection system or other guardrail device in conjunction with administrative controls that provide the same or a greater level of protection for the employees who work on mobile equipment above 4 feet.
