29 CFR 1926.95(a):Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. A) Worksite - On or about November 22, 2022, a carpenter was using a hard hat that was not maintained in a reliable condition. The hard hat was manufactured in 1995 and the shell was covered in old stickers and scratches. The headband had been repaired with electrical tape.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks: a) Worksite - On or about November 22, 2022, employees walked under the boom and elevated load of the Magni 5.25 rotating telescopic handler. b) Worksite - On or about November 22, 2022, the Magni 5.25 rotating telescopic handler lifted a pallet with unsecured rebar, and toolboxes. The unsecured material fell from the the pallet. c) Worksite - On or about November 22, 2022, the forks of the Magni 5.25 telescopic handler were not tilted back to stabilize the load.
