29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Gordos Framing at 7700 South Brett Avenue, Sioux Falls, SD 57108: On or about and at times prior to November 25, 2022, the employer did not ensure that an employee operating the JCB 510-56 All-Terrain Telescopic Material Handler was competent to operate by ensuring the employee completed operator training, evaluation, and certification prior to use.  This condition exposed employees to struck-by hazards.

This condition exposed the employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step:  (a)Gordos Framing 7700 South Brett Avenue, Sioux Falls, SD 57108: On or about and at times prior to November 25, 2022, the employer did not ensure that employees were not utilizing the top step of the 8-foot Keller K-Pro Fiberglass A-frame step ladder for access to the upper level framing of the multi-family residential property.  This condition exposed employees to fall hazards greater than eight feet.
