29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - 74-97 Willow Court, Hamilton NJ: The company owner and their workers engaging in roof shingle rip, tear, replace and other related activities were exposed to fall hazards in excess of 25 feet to the ground surface below, when walking on and working from the pitched roofs of a residential structure without the use of fall protection.  Condition noted  on or about 11/28/22.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.   a- 74 - 97 Willow Court, Hamilton NJ: A worker was exposed to fall hazards, in excess of 25 feet to the ground surface below, when accessing and egressing the roof of a residential structure using an aluminum extension ladder containing structural defects. Condition observed on or about 11/28/22.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a- 74-97 Willow Court, Hamilton NJ: On or about 11/28/22 workers were exposed to fall hazards, up to and in excess of  19 feet to the ground surface below, while standing in a metal box that was secured to the back rest of an all terrain fork truck with a chain.  At this time these workers were not utilizing any fall protection nor was the box supplied with guardrails or other approved means of fall protection.    b- 74-97 Willow Court, Hamilton NJ: On or about 11/29/22 the company owner and company workers were exposed to fall hazards, up to and in excess of  25 feet to the ground surface below, while they were being delivered to the pitched roofs of a residential structure while standing in a metal box that was secured to the back rest of an all terrain fork truck with a chain.  At this time the company and company workers were not utilizing any fall protection nor was the box supplied with guardrails or other approved means of fall protection.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
