29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) a) Walden Community Development, Lot# 24 Bunting Circle, Maull Road, Harbeson, Delaware 19951: CSHO observed employees walking, working and standing on a timber framed residential structure at heights greater than 15 feet. CSHO observed Mr. Ramirez, Foreman/Owner and competent person, expose himself to the same hazard without regard for his safety or that of his employees. Mr. Ramirez stated he was aware of the hazards, did not initiate frequent and regular inspections of working conditions, and made no effort to abate it.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Walden Community Development , Lot# 24 Bunting Circle, Maull Road, Harbeson, Delaware 19951: Employees observed walking, working and standing on a timber framed residential structure at heights greater than 15 feet where there were no fall protection systems in place. Some employees wore fall protection but were not tied off or secured to anchor points.
