This condition exposed employees to egress hazards in the event of a trench wall cave in.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Meyer Services Inc. at 20007 466th Avenue, Bruce, SD 57220: On or about and at times prior to November 29, 2022, the employer did not ensure that employees were protected from cave-in hazards associated with trench wall cave-in while conducting work in an excavation greater than five feet in depth. This condition exposed employees to cave-in and struck-by hazards associated with trench wall cave in.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Meyer Services Inc. at 20007 466th Avenue, Bruce, SD 57220: On or about and at times prior to November 29, 2022, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify soil conditions and did not ensure an adequate protective system was installed prior to an employees entering the excavation. This condition exposed the employees to struck-by and crushed-by hazards while working within the unprotected excavation.
