29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) 3121 W. Hampden Ave, Sheridan, CO 80110: On or about 11/29/2022, and at times prior, the employer did not have a written respiratory protection program where: 1) Employees were required to wear respirators during preparation of stone countertop slabs for installation including but not limited to cutting, drilling, and polishing. 2) Employees were assigned elastomeric respirators. N95 filtering facepiece respirators were also available for use. 3) Employees had not been provided medical evaluations or respirator fit tests. 4) No cleaning procedures were in place or practiced by employees. Respirators were stored hung by the straps and without a form of dust cover.

29 CFR 1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan: (a)3121 W. Hampden Ave, Sheridan, CO 80110: On or about 11/29/2022, and at times prior, employees cutting and installing stone countertops were not covered by a written silica exposure control plan: 1) No written exposure control plan was available at the time of inspection. 2) Employees use equipment to cut stone including but not limited to: EmmeDue slab cutting machine, handheld cutoff wheels, and handheld drills. 3) Control measures observed include water integration and application, integrated dust collection shrouds on tools, shop vacuums, wet methods for housekeeping in the shop, and use of respirators.
