OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to potential fire, deflagration and explosion hazards associated with combustible wood dust. a) Production floor: Employees were exposed to fire, deflagration and explosion hazards due to the Dustek Whispurr dust collection systems, models W750 and W1000, which were collecting combustible dust from nine different woodworking machines, located within the building, on or about 1/25/23. b) Production floor: Employees were exposed to fire, deflagration and explosion hazards in that the Dustek Whispurr dust collection systems, models W750 and W1000, which were collecting combustible dust recirculated air back into the building, on or about 1/25/23. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces were kept in a clean, orderly, and sanitary condition. a)ABC Holdings Inc. 1000 Delsea Drive Suite F3 Westville, NJ 08093, Production Floor: An accumulation of explosive wood dust was observed on the floors, and on the surface of equipment, pipes, and beams throughout the production floor, exposing employees to fire hazards, on or about 11/30/2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
