On or about November 18, 2022, the employer did not ensure Pie Line Workers performing service and maintenance activities on the Graybill Pie Line Marker Machine, utilized energy control procedures to control the hazardous electrical energy while cleaning dough from the marker roll.

29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about November 18, 2022, the employer did not ensure Pie Line Workers performing service and maintenance activities by cleaning dough from the Marker Machine on the Graybill Pie Line Marker Machine applied and followed the established energy control procedures by; turning off or shutting down the marker machine [per 1910.147(d)(2)], isolated the marker machine from the electrical energy source [(d)(3)], affixing lockout device(s) to the energy isolation device(s) [(d)(4)(i), and verifying de-energization and isolation had been accomplished [(d)(6)], prior to cleaning dough from the machine.

29 CFR 1910.147(c)(7)(i):The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: On or about November 18, 2022, the employer failed to provide training to ensure affected and authorized employees working on the Graybill Pie Line understood the purpose and function of the energy control program and employees had acquired the knowledge and skills required for the safe application, usage, and removal of energy controls. The employer engages in the service and maintenance activities on machinery and equipment including, but not limited too; cleaning the marker machinery of the Graybill Pie Line.
