29 CFR 1910.120(q)(1):The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: On or about November 9, 2022 at 1888 Southway Street, Massillon, OH 44646, the employer failed to ensure employees responding to a 500-gallon spill involving Quandexx 700, implemented the emergency response plan prior to allowing the clean-up to begin.

29 CFR 1910.120(q)(6): The skill and knowledge levels required for all new responders, and those hired after the effective date of this standard, were not conveyed to them through training before they were permitted to take part in actual emergency operations on an incident: On or about November 9, 2022 at 1888 Southway Street, Massillon, OH 44646, the employer failed to ensure employees responding to a 500-gallon spill involving Quandexx 700, were trained on the employers' emergency response plan prior to allowing them to perform cleanup.
