29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Warehouse - On or about December 1, 2022, an employee was not required to utilize a personal fall arrest harness to retrieve stock stored at a height of 6 feet while on the unguarded work platform of a Crown SP3020-30 Electric Order Picker thereby exposing them to falls to a lower level. The employee was not protected by any of the systems described in 29 CFR 1910.28(b)(1)(i). Abatement certification or documentation is not required for this item.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Warehouse - On or about December 1, 2022, the employer did not ensure that employees who operate powered industrial trucks, including Crown SP3020-30 Electric Order Picker Forklifts were properly trained, evaluated and certified to perform tasks in a safe manner, thereby exposing employees to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910(a)(1): Scaffolds used in general industry must meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). 29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) Sales floor - On or about October 15, 2022, an employee operating a Skyjack SJIII 3219 mobile elevating work platform, SN22071948, was permitted to use a guardrail as a step to gain access to lighting equipment near the ceiling while at the platform's maximum height of 19 feet thereby exposing the employee to falls to a lower level. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
