29 CFR  1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :    a) Inside the Range:   Range Safety Officers (RSOs) who were observing/instructing customers shooting inside the shooting range were exposed to noise levels in excess of the OSHA Permissible Exposure Limit of 90 dBA and the employer did not obtain a new audiogram for each range safety officer on or about 1/30/23.   b) Inside the Range:   Range instructors who were instructing/observing customers shooting inside the shooting range were  exposed to noise levels  which ranged in excess of the excess of the OSHA Action Level of 85 dBA were not obtain a new audiogram for each range instructor on or about 1/30/23.   In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19.

29 CFR 1910.1025(h)(1):  All surfaces were not maintained as free as practicable of accumulations of lead:  a.	Inside the RSO Booth:    The top surface of the electrical panel was contaminated with  2986.6 micrograms per 100 square centimeters (ug/100 cm2) of lead; on or about 12/1/22.  b.	Outside the Range/Customer Service Area:   Tile floor areas near the door leading to sally-port was contaminated with between 607.77 ug/100 cm2 to 1033.0 ug/100 cm2  of lead; on or about 12-1-22.   c.	Outside the Range/Behind the Range Customer Service Counter:    The rubber mat was contaminated with 969.08 ug/100 cm2 of lead  on or about 12/17/23.  d.	Outside the Range in the Training Area:   The floor outside the classroom was contaminated with 172.81 ug/100 cm2 of lead after  vacuuming of the area had been completed on or about 1/15/23.  In addition to abatement certification, the employer is required to submit abatement documentation for this item.  Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19  REPEAT STATEMENT:    Blueline Tactical & Police Supply, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard [29 CFR 1910.1025(h)(1)], which was contained in OSHA inspection number 1545899, citation number 1,  item number 3 and was affirmed as a final order on  2/28/2023, with respect to a workplace located at 444 Saw Mill River Road, Elmsford, NY 10523.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  a)  Inside the Shooting Range:   Range Safety Officers that performed weekly cleaning of the range involving HEPA vacuuming and manual scooping and removal of spent shell casings from collection troughs were required by the employer to wear  air purifying respirators for protection P100 filters with against lead and were not fit tested prior to the initial use of the respirators; on or about 1/30/23.  In addition to abatement certification, the employer is required to submit abatement documentation for this item. 29 CFR 1910.1025(d)(2):  An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  a) Inside the Range:   Range safety officers (RSOs) performed weekly surface cleaning and vacuuming of the range surfaces to remove lead surface contamination and the employer did not initially determine if employees were exposed to lead at or above the action level; on or about 12/1/23.  b) Inside the Range:   Range safety officers (RSOs) performed weekly cleaning of the range when removing spent shell casings from troughs and the employer did initial determine if employees were exposed to  lead at or above the action level; or about 12/1/23.    Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
