29 CFR 1926.300(b)(3): "Types of guarding." One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are - barrier guards, two-hand tripping devices, electronic safety devices, etc. a. On or about November 20, 2022, employees engaged in boring underneath the highway in order to install 12 inch diameter steel casing were exposed to the hazard of getting caught-in/between the rotating spoil paddles and the frame of the soil chamber while unjamming a steel pipe casing from the master push ring on the Michael Byrne 36- inch Horizontal Earth Auger Boring Machine due to an opening under the spoil door. As a result, an employee's leg was caught-in the spoil chamber.

On or about August 8, 2022, a work-related injury occurred. The employer did not ensure that the object which directly injured the employee was recorded in Column F of the 2022 OSHA 300 Log. 2. On or about November 30, 2022, a work-related injury occurred. The employer did not ensure that the object which directly injured the employee was recorded in Column F of the 2022 OSHA 300 Log.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a) Located at the job site in the vicinity of I-70E at Underwood Avenue: On or about November 30, 2022, and at times prior, the employer did not ensure that a competent person inspected the boring pit prior to the start of work and as needed, thereby exposing employees to potential cave-in hazards.
