29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about December 1, 2022, the employer did not ensure that adequate frequent and regular inspections were conducted to ensure that fall protection was being utilized by each employee exposed to a fall height greater than 19'.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about December 1, 2022, employees had not been trained on fall protection systems and on the hazards associated with falls in that employees were not wearing a fall protection system while working at a height of 19 ft.

29 CFR  1926.501(b)(10):"Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.  a) On or about December 1, 2022, employees were exposed to a 19 ft. fall hazard while performing framing work on a commercial jobsite with 5-12 pitch roof without any means of conventional fall protection.  Maverick Construction Services, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1467802, citation number 1, item number 1 and was affirmed as a final order on June 24, 2020 , with respect to a workplace located at Trotters Way, Liberty TWP, OH 45044.
