Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to fire and explosion hazards: Or in the alternative: 29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors: (a) On or about December 2, 2022, and times prior at or near 37th Street NW & 113th Avenue NW in Keene, North Dakota, employees were exposed to fire and explosion hazards while conducting maintenance on a natural gas sales line where flammable vapors and liquids were released and potential sources of ignition were present. Note: Among other methods, feasible and acceptable abatement methods to correct this hazard include but are not limited to following the American Petroleum Institute Recommended Practice 99, Flash Fire Risk Assessment for the Upstream Oil and Gas Industry section 4 - which requires that employers conduct risk assessment and utilize controls to mitigate the risk of flash fire injury.
