OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about November 30, 2022, and at times prior thereto, at the trailer wash dock, employees were exposed to struck by hazards while the operator maneuvered a trailer into position for cleaning.

29 CFR 1910.132(d)(1)(i): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about November 30, 2022, and at times prior thereto, at the trailer wash dock, personal protective equipment, such as safety glasses, were not used to protect employee from hazards during trailer washing operation.
