OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using a ladder platform shingle hoist to access the roof.  Location: Jobsite- Front of house  On December 6, 2022, employees were exposed to fall hazards of up to 13 feet while using a ladder platform shingle hoist to access the roof. The hoist was not designed to be used in place of a ladder and was not equally supported as it rested against the gable end of the house.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   Location: Jobsite  On December 6, 2022, employees were exposed to struck by hazards while working on the ground as other workers were working on the roof, where protective helmets were not utilized.

Employees working from the roof were exposed to fall hazards of greater than 6-feet, where fall protection was not properly utilized.
