OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and  explosion hazards:  (a) On October 31, 2022, at the Missouri North and West Central Tank Battery at or near Trenton, ND, an employee was exposed to a flash fire and explosion hazard while responding to an electronic submersible pump (ESP) alarm where adequate monitoring or personal gas monitor was not provided for the detection of flammable vapors (LEL).  (b) On October 31, 2022, at the Missouri North and West Central Tank Battery at or near Trenton, ND, an employee was exposed to a flash fire and explosion hazard while responding to an electronic submersible pump (ESP) alarm where a fire risk assessment was not conducted where flammable vapors and potential sources of ignition were present.   Note: Among other methods, feasible and acceptable abatement methods to correct this hazard include but are not limited to:  1. Follow the American Petroleum Institute Recommended Practice 99, Flash Fire Risk Assessment for the Upstream Oil and Gas Industry section 4 - which requires that a Fire Risk Assessment be conducted to assess the risk of flammable vapors reaching an ignition source.

29 CFR  1910.1200(h)(3)(i): Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.);  a) On October 30, 2022, and at times prior, at or near Missouri North and West Central Tank Battery in Williams County near Trenton, ND, employees were not trained to check or monitor the gas Lower Explosive Limit (LEL) that may be present when gas vapors are being released into the atmosphere.

29 CFR  1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used:  a) On  October 30, 2022, and at times prior at or near Missouri North and West Central Tank Battery in Williams County near Trenton, ND, prior to being allowed to work in areas with potential fire and explosion hazards, employees were not provided training that would allow them to recognize and effectively protect them from the hazardous conditions.
