OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that inspections were not conducted on a mobile scaffold and workplace to ensure employees are not exposed to fall hazards.  a) Jobsite located at 260 W. Baltimore Pike, Media PA 19063 - On or about December 5, 2022, the employer did not ensure inspections such as, but not limited to pre-operation,  workplace and scheduled inspections were performed prior to employees operating a powered mobile scaffold (Genie Scissor Lift 1930).  Among other methods, feasible and acceptable means of hazard abatement include but are not limited to:  1. Follow the Genie GS-1930 Operator's Manual inspection requirements and utilize pre-operation and workplace inspection checklists.  2. Follow scheduled maintenance inspection as per Genie GS-1930 Service Manual. 3. Follow American National Standards Institute (ANSI)/Scaffold and Access Industry Association (SAIA) A92.22-2018 Mobile Elevating Work Platforms (MEWPs) SAFE USE 2021  Section 5.1 Scheduled Maintenance: 5.1.1 Ensure maintenance specified in this standard is properly performed on a timely basis. Establish a preventive maintenance program in accordance with the manufacturer's recommendations and take into account the environment of the workplace and severity of use of the MEWP. 5.1.2 Comply with the scheduled maintenance program including inspections as defined in this section of this standard and by the manufacturer's requirements and safety related bulletins. All malfunctions and problems identified that affect safe operation shall be corrected by a qualified person and authorized by the owner before the MEWP is returned to service.  Section 5.3 Frequent Inspection:  5.3.1 Prior to placing the MEWP into service, ensure a frequent inspection is performed in accordance with the requirements of sections 5.3.2, 5.3.3 and 5.3.4 and the manufacturer's instructions unless it is determined that the frequent inspection is current. 5.3.2 A frequent inspection is required if the MEWP has been out of service for a period longer than three months, or if environmental conditions require a shorter period. 5.3.3 The inspection shall be made by a person qualified to inspect the specific make and model of the MEWP. The inspection shall include all items specified by the manufacturer for a frequent inspection, to include manufacturer's bulletins.  Section 5.4 Annual Inspection:  5.4.1 Ensure an annual inspection is performed no later than thirteen (13) months from the date of the prior annual inspection. The inspection shall be performed by a person qualified to inspect the specific make and model of MEWP. The inspection shall include all items included in the frequent inspection (see 5.3.3) plus items specified by the manufacturer for an annual inspection, to include manufacturer's bulletins. The inspection shall verify that the MEWP is registered with the MEWP manufacturer and that any open safety-related bulletins are addressed as part of the inspection. The MEWP shall not be placed back into service until all malfunctions and problems identified in the inspection have been corrected.  Section 5.5 Pre-Start Inspection:  Before each day or at the beginning of each shift, ensure and the operator shall perform a pre-start and functions test.

29 CFR  1926.452(w)(6)(i): Employees shall not be allowed to ride on scaffolds unless the surface on which the scaffold was being moved was not within 3 degrees of level:  a) Jobsite located at 260 W. Baltimore Pike, Media PA 19063 - On or about December 5, 2022, the employer did not prevent employees from riding on a powered mobile scaffold (scissor lift) on a surface that was greater than 3 degrees of level. Employees rode on a powered mobile scaffold (Genie Scissor Lift 1930) on a surface that was approximately 6 degrees from level, thereby exposing employees to fall hazards from scaffold tip over.

29 CFR  1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question:  On or about December 5, 2022, the employer did not ensure that each employee involved in the moving and operating of a powered mobile scaffold (scissor lift) was trained to recognize the hazards associated with the work in question. An employee that operated a mobile scaffold (Genie Scissor Lift 1930)  to install lighting was not trained by a competent person.
