29 CFR  1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    On or about December 6,2022, on the roof of the Inn at the Mill Hotel, a safety and health program was not implemented to identify and eliminate employee exposure to fall hazards in the following instances:  a) One employee was using the weather vane as a fall protection anchor point;  b) Employees did not use roof anchors as fall protection anchor points;  c) Employees tied their lifelines through the ridge vent opening to the trusses below;  d) Employees were removing the shingles without fall protection;  e) Employee harnesses were not adjusted correctly so as to remain on their body in the event of a fall.

29 CFR  1926.501(b)(10):  Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems:  On or about December 6, 2022, employees were removing shingles from the roof of the Inn at the Mill Hotel without using fall protection and were exposed to the hazard of falling approximately twenty feet from the roof to the ground below in the following instances:  a) Two employees were not utilizing any fall protection,  b) Two employees were wearing harnesses, but were not tied off.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a) On or about December 6, 2022, an employee removing shingles from the 12:12 pitch roof surface of the tower of the Inn at the Mill Hotel was exposed to the hazard of falling approximately twenty feet from the roof to the ground below.
