29 CFR 1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): In Jones Warriner Inpatient Psychiatry Unit, healthcare facility at 725 North St. Pittsfield, MA 012001: On or about December 3, 2022, the employer did not ensure that all employees required to wear N95 respirators had passed a qualitative or quantitative fit tests prior to use. A Staff Nurse, who did not pass a fit test, continued to wear an N95 respirator, while taking vital signs and providing medications to COVID positive patients. Employees are required to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed COVID-19 positive patients.

29 CFR 1910.134(f)(2):The employer did not ensure that employees using a tight-fitting respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece was used, and at least annually thereafter: In Jones Warriner Inpatient Psychiatry Unit, healthcare facility at 725 North St. Pittsfield, MA 012001: On or about December 3, 2022, the employer did not provide an annual fit test to all employees required to wear a respirator. At least two (2) nurses that were required to wear respirators, had not had an annual fit test after their initial fit test. Employees are required to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed COVID-19 positive residents.
