29 CFR  1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  a. Outside Aboveground Storage Tank - On or about December 7, 2022, the employer did not adequately assess what personal protective equipment was required in the facility, including eye and face protection, to protect affected employees against contact with chemicals such as liquified propane.

29 CFR  1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about December 7, 2022, outside near the 1450 gallon Aboveground Propane Storage Tank, the employer did  not ensure that the employees used protective safety glasses, goggles or face shields when required to fill customer's 20-or-40 lb. propane tanks.  Employees were thereby, exposed to potential eye injuries from liquified propane.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a. Inventory, Feed, & Shipping & Receiving - On or about December 7, 2022, the employer did not ensure that employee(s) who operate powered industrial vehicles, including the Crown LP forklift, Model C-5 1050-50, Serial No. 10147224, Crown electric pallet jack, Model WP3035-45, Serial No. 10146947, and Crown RR Electric Reach forklift, Type E140-15, were properly trained, evaluated and certified to perform the tasks in a safe manner, thereby exposing employees to struck-by hazards.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a.  Facility wide - On or about December 7, 2022, the employer did not develop and implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were required to work with or around chemicals and exposed to hazardous materials, including propane.

29 CFR  1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted if no barriers to immediate employee access in each workplace are created by such options.)  a. Facility Wide - On or about December 7, 2022, the employer failed to maintain copies of safety data sheets for each hazardous chemical in the workplace. Safety data sheets were not available to employees required to work with or around hazards chemicals, including propane.
