29 CFR 1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a.) On or about December 8, 2022, the employer did not assure powered industrial vehicle operators were evaluated for operator performance every three years. Employees were required to operate the powered industrial trucks to move materials from inside their tractor-trailers to areas where storage is designated. Employees are exposed to struck-by injuries from powered industrial trucks, in that their training frequency was greater than three years.
