29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented. On or about December 7, 2022, and at times prior thereto, employees were installing plywood flooring to a residential home under new construction without the use of a fall protection system, exposing the employees to a hazard of falling approximately nine feet to the ground.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about December 7, 2022, and at times prior thereto, employees used Mikita 5007F saws to cut plywood to install flooring at a residential home under new construction without wearing eye protection, exposing the employees to the hazard of being struck in the eye(s) by flying debris or projectiles.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about December 7, 2022, and at times prior thereto, employees installed Tyvek Commercial Wrap to the sides of homes using a Louisville LPB01 Jump Jack scaffold without using a fall arrest system or guardrails, exposing employees to fall hazards of approximately fifteen feet.
