29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about December 08, 2022, during a roof replacement of a residential house located at 2019 W 58th St, Cleveland, OH 44102, employees were using an extension ladder to access the roof. The employer did not ensure the extension ladder extended 3 feet above the roof, exposing employees to fall hazards of approximately 16 feet to the ground below while accessing the roof (upper land surface.)

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about December 08, 2022, during a roof replacement of a residential home located at 2019 W 58th St, Cleveland, OH 44102, the employer did not ensure employees were protected from possible danger of eye injury from impact or from flying objects. Employees were exposed to eye injuries from flying debris or nails by using pneumatic air guns without the use of eye protection.  5 Star Roofing & Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.102(a)(2) Eye and face protection), which was contained in OSHA inspection number 1502924, citation number 01, item number 001 and was affirmed as a final order on 12/29/2020, with respect to a workplace located at 819 Wooster Rd, Barberton, OH 44203.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about December 08, 2022, during a roof replacement of a residential home located at 2019 W 58th St, Cleveland, OH 44102, the employer did not ensure employees working on the roof were protected from a fall approximately greater than 25 feet by utilizing a personal fall arrest system or any other form of fall protection system.  5 Star Roofing & Exteriors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) Duty to have fall protection), which was contained in OSHA inspection number 1502924, citation number 01, item number 002 and was affirmed as a final order on 12/29/2020, with respect to a workplace located at 819 Wooster Rd, Barberton, OH 44203.
