29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access. a) On or about 10/28/2022, at the Starbucks under reconstruction, located on 2590 Ridgeway Avenue, in Rochester, New York, the employer did not enforce safe ladder use. The employer allowed employees to use a portable ladder to access a roof without ensuring that the ladder side rails extended 3 feet above the roof landing and exposed them to falling 14 feet to lower levels. NO ABATEMENT CERTIFICATION REQUIRED
