29 CFR  1910.178(m)(5)(ii):  A powered industrial truck is unattended when the operator is 25 ft. or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view.  (a)  On or about December 9, 2022, the operator of a Caterpillar TL1055C Telehandler exited the vehicle and left it unattended to climb onto the roof of an adjacent building.  The operator also left the boom raised, with another employee was standing on a wooden constructed platform, and turned his back to the vehicle.  This conduction exposed employees to struck-by and falling hazards.

This condition exposed employees to hazards associated with trips and falls.

29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  (a) On or about December 9, 2022, the employer did not ensure that workers at a lower level of a residential construction project were protected by protective helmets, in that an employees on the third floor roof used a power saw to remove  the top brace from a pumpjack scaffold, while another worker stabilized the scaffold pole on the second floor roof.  This condition exposed employees to struck-by hazards.

29 CFR 1926.451(a)(6):  Scaffolds were not designed by a qualified person:    (a)  On or about December 9, 2022, the employer did not ensure that a scaffold was designed by qualified person in that,  employees were permitted to ride on a wood constructed work platform, supported on the front tines of a Caterpillar TL1055C Telehandler, which was lifted from ground level to the third floor of a residential structure.  This condition exposed employees to a crushing injuries and a fall of approximately 25 feet.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about December 9, 2022, the employer did not ensure that workers dismantling a pumpjack scaffold, located on the second floor roof, were protected from hazards associated with falls.  This condition exposed employees to hazards associated with falls from approximately 11 feet 2 inches.  (b)  On or about December 9, 2022, the employer did not ensure that workers dismantling a pumpjack scaffold, located on the third floor roof, were protected from hazards associated with falls.  This condition exposed employees to hazards associated with falls from approximately 25 feet.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  (a)  On or about December 9, 2022, the employer did not ensure all powered industrial truck operators were trained in operation of powered industrial trucks in that the operators were not trained in the use of the Caterpillar TL1055C Telehandler prior to its use.  This condition exposed employees to hazards associated with struck by injuries.  Note:  The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.179(l) of this chapter.
