29 CFR  1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  a)	Mario Pacheco DBA Polosma Construction LLC. On or about December 12, 2022, at the address of 614 East Main St. Lakeside Marblehead OH 43440: The employer did not ensure that each powered industrial truck operator successfully completed the training and evaluation, prior to permitting employee(s) to operate powered industrial trucks (Hangcha LP: Model Type CPYD25-XW71F, Serial # 12BB01551). Without the benefit of training and evaluation, PIV operators, as well as others working in and around forklift operating areas were exposed to struck-by/crushed-by hazards.

29 CFR  1926.153(j):Storage of LPG containers. Storage of LPG within buildings is prohibited.  a)	Mario Pacheco DBA Polosma Construction LLC. On or about December 12, 2022, at the address of 614 East Main St. Lakeside Marblehead OH 43440: The employer did not ensure that LP-Gas (propane cylinders) maintained onsite were stored in a location outside the structure. Three LP-Gas propane cylinders used to fuel a powered industrial vehicle were stored inside a building (hotel) under renovation. Employees working in the area of the stored LPG tanks, were exposed to fire and burn hazards.

29 CFR  1926.501(b)(14):Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a)	Mario Pacheco DBA Polosma Construction. On or about December 12, 2022, at the address of 614 East Main St. Lakeside Marblehead OH 43440: The employer did not ensure employees working in rooms where windows (5' x 4') were removed, leaving an opening for debris discharged, were adequately protected from falls.  Employees operating near the unguarded window openings were exposed to fall hazards 25 feet or greater to the ground below.
