29 CFR 1910.178(a)(6):The employer did not ensure that all nameplates and markings were in place: a. Durez Corporation worksite located 13717 US HWY. 68 S Kenton, OH 43326: On or about December 12, 2022, in Building 51, Kettle Room, the employer did not ensure a 3000 lb. Yale Counterbalanced Electric Pallet Stacker, Model # MCW030LCN24CF072, used to move a pallet of Acide Oxalique, maintained a capacity plate that was legible. Without such plate, the operator was not able to effectively evaluate the lifting capabilities of the vehicle.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set: a. Durez Corporation worksite located 13717 US HWY. 68 S Kenton, OH 43326: On or about December 12, 2022, in Building 51, Kettle Room, the employer did not ensure that the operational controls and power on the 3000 lb. Yale Counterbalanced Electric Pallet Stacker, Model # MCW030LCN24CF072 were neutralized prior to leaving the vehicle unattended. Power industrial vehicles left unattended with the power switch in the on position, exposed employees working on or around the aforementioned unit to unexpected movement of the vehicle and struck-by hazards.
