29 CFR 1926.852(e): Chute openings, into which workmen dumped debris, were not protected by substantial guardrails approximately forty-two inches above the floor or other surface on which men stood to dump material: A) Angelo's Roofing Inc. on or about October 11, 2022 at the address of 242 East 16th Street, Erie, PA: Employees utilizing the roof debris chute on the west side of the structure were not protected by guardrails and/or other means of fall protection systems. Employees were using the chute for roofing debris during tear off operations roughly 30 feet above the ground below.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: A) Angelo's Roofing Inc. on or about October 11, 2022 at the address of 242 East 16th Street, Erie, PA: Employees working on the north side of the structure were not protected from fall of roughly 30 feet to the ground below. Employees were not provided with any type of fall protection when traveling to the roof debris chute on the west side of the structure.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: A) Angelo's Roofing Inc. on or about September 21, 2022 at the location of 242 East 16th Street, Erie, PA: An employee sustained disabling injuries and was hospitalized from a fall of roughly 30 feet, while working on the roof of the structure. The employer did not report the employee hospitalization to the Erie Area OSHA Office within 24-hours.
