29 CFR 1910.179(b)(8): Employees other than designated personnel were permitted to operate cranes: (a) On 12/13/22, the employer did not ensure that only designated personnel operated a gantry crane. An employee who was not trained how to safely operate a gantry crane inadvertently activated a button on the hand-held controller that operated a gantry crane when she was attempting to detach the clamp that was connected to the top of a steel I-beam on the facility floor. The employee was struck by the I-beam when it fell over onto its side and sustained serious injuries. This condition exposed the employee to a struck-by and crushing hazards. (b) On or before 12/14/22, the employer did not ensure that only designated personnel operated the 5-ton and 10-ton gantry cranes in the facility. Employees who have not been trained in the safe use of each gantry crane have operated both gantry cranes on multiple occasions to move steel I-beams. The cranes are used to move individual beams by attaching a sling and clamp to the top of the beam. This condition exposed the employee to a struck-by and crushing hazards.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done: (a) On or before 12/14/22, the employer did not verify that the required workplace hazard assessment had been performed through a written certification. Employees operate gantry cranes in the facility to move steel I-beams. Employees also weld on steel. This condition potentially exposed employees to hazards associated with handling and welding on steel material.
