29 CFR 1926.651(h)(3): Excavations subject to runoff from heavy rains were not inspected by a competent person to ensure compliance with 29 CFR 1926.651(h)(1) and (h)(a): On or about December 14, 2022, and at times prior thereto, the employer did not ensure a competent person performed inspections of excavations prior to beginning operations, exposing employees to the hazard of a cave-in. Instance 1) On or about December 14, 2022, an employee entered a trench to assist with the removal of mud and water from around and inside of the boring hole with the use of a hose and vacuum truck. Instance 2) On or about December 12, 2022, an employee entered a trench to assist with the removal of dirt from around a water line by hand. Instance 3) On or about December 12, 2022, an employee entered a trench to assist with the repair of a broken water line.
