29 CFR 1926.651(k)(1): Where employee exposure to cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions could be reasonably anticipated, the onsite competent person failed to conduct an inspection of the excavation, adjacent areas, and protective systems prior to the start of the work and/or as needed throughout the shift to identify such conditions. (a) 3204 Crest Road, Harrisburg, PA 17109 ? On or about December 13, 2022, the onsite competent person failed to adequately inspect the jobsite prior to and during sewer lateral line repair work in the front yard of the residence, thus exposing employees to hazardous conditions associated with an unidentified natural gas line. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)3204 Crest Road, Harrisburg PA 17109 - On or about December 13, 2022 the employer did not ensure that employees conducting sewer lateral line repair work in the front yard of the residence were trained to recognize unsafe conditions caused by excavating once it was determined that there was an unidentified natural gas line in the dig area. An employee operated a Kobota mini excavator to dig at the dig area despite the gas line location not being determined. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

(a)3204 Crest Road, Harrisburg PA 17109 - On or about December 13, 2022 the onsite competent person did not ensure that employees conducting sewer lateral line repair work in the front yard of the residence proceeded with caution to dig once it was determined that there was an unidentified natural gas line in the dig area. An employee operated a Kobota mini excavator to dig at the dig area despite the gas line location not being determined. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
