29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about December 15, 2022, and at times prior thereto, at the commercial construction site, the employer did not ensure employees were using the ladder side rails extended at least three (3) feet above the upper landing surface to access the roof, exposing employees to fall hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun. On or about December 15, 2022, and at times prior thereto, at the commercial construction site, employees installing shingles on the roof of a one-story building did not wear or have available safety glasses while using a nail gun, exposing employees to struck-by and flying particles hazards. Magnolia Services Group was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1378889, citation number 001, item number 001, issued on March 19, 2019, and was affirmed as a final order on April 16, 2019, with respect to a workplace located at 933 21st Avenue, Tuscaloosa, AL 35405.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about December 15, 2022, and at times prior thereto, at the commercial construction site, the employer did not ensure employees installing shingles on the roof of a one-story building wore fall protection at about nine (9) feet or more above the lower levels, exposing employees to fall hazards. Magnolia Services Group was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1378889, citation number 001, item number 002, issued on March 19, 2019, and was affirmed as a final order on April 16, 2019, with respect to a workplace located at 933 21st Avenue, Tuscaloosa, AL 35405.
