29 CFR  1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a) Utility Room - On or about December 14, 2022, the employer did not develop and implement a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  Employees were required to with or around category 1 and 2 corrosive chemicals and skin/eye irritants, including concentrated Clorox Germicidal Bleach (contains sodium hydroxide),  Husky 824 Quick Care Disinfectant (contains dimethyl benzyl ammonium chloride), and All-purpose ammonia cleaner.

29 CFR  1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)   a) On or about December 16, 2022, the employer failed to maintain copies of safety data sheets for each hazardous chemicals in the workplace. Safety data sheets were not available to employees required to work with or around hazardous chemicals including category 1 and 2 corrosive chemicals and skin/eye irritants, including concentrated Clorox Germicidal Bleach (contains sodium hydroxide),  Husky 824 Quick Care Disinfectant (contains dimethyl benzyl ammonium chloride), and All-purpose ammonia cleaner.

29 CFR  1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a) On or about December 16, 2022, in the facility, employees were required to work with and/or around hazardous chemicals including, but not limited to, category 1 and 2 corrosive chemicals and skin/eye irritants, including concentrated Clorox Germicidal Bleach (contains sodium hydroxide), Husky 824 Quick Care Disinfectant (contains dimethyl benzyl ammonium chloride), and All-purpose ammonia cleaner. Employees were not provided training on hazardous chemicals.
