29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Main House Roof: Employees were exposed to fall hazards of approximately 20 (twenty) feet due to a lack of guardrail systems, safety net system, or personal fall arrest system, on or about December 19, 2022. b) Garage Roof: Employees were exposed to fall hazards in excess of 9 (nine) feet due to a lack of guardrail systems, safety net system, or personal fall arrest system, on or about December 19, 2022. The Employer, Jose Pina dba Pina Construction, was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1395138, citation number 1, item number 1, and was affirmed as a final order on September 4, 2019, with respect to a workplace located at 1480 Wyndham Drive, York, Pennsylvania 17403. Abatement certification and documentation required.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Front of Main House: Employees were subject to fall hazards while accessing the roof of the house due to a ladder that was not set-up so that its side rails extended 3 (three) feet past the upper landing surface, on or about December 19, 2022. b) Garage: Employees were subject to fall hazards while accessing the roof of the garage due to a ladder that was not set-up so that its side rails extended 3 (three) feet past the upper landing surface, on or about December 19, 2022. The employer, Jose Pina dba Pina Construction was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(1), which was contained in OSHA inspection number 1395138, citation number 1, item number 3, and was affirmed as a final order on September 4, 2019, with respect to a workplace located at 1480 Wyndham Drive, York, PA 17403.
