OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, that employees were exposed to crushing hazards, struck-by hazards, and ejection hazards during the operation of powered industrial trucks: (a) Coleman Worldwide Moving, LLC., at 2160 South Hancock Expressway, Colorado Springs, CO: On or about 12/14/2022, and at times prior, the employer, Coleman Worldwide Moving, LLC., did not ensure employees utilizing powered industrial trucks or forklifts, to offload, transport and move material were protected from crushing, struck-by, and ejection hazards in that forklifts were operated without seat belt assemblies. The following forklifts were utilized without seatbelt assemblies or seatbelt assemblies were not in working order: -A Hyster propane fueled forklift S50 XM, SN# D187V16854X was operated without a functional seat belt assembly. -A Toyota propane fueled forklift 8FGU25, SN# 16687 Yale WCI 306 diesel forklift was operated without a seat belt assembly. -A Hyundai, 30L-7A, Forklift was operated without a seat belt assembly.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) (a) Coleman Worldwide Moving, LLC., at 2160 South Hancock Expressway, Colorado Springs, CO: On or about 12/14/2022, and at times prior, the employer, Coleman Worldwide Moving, LLC., did not ensure powered industrial trucks (PIT) were removed from service after the employer identified defects and missing parts in the powered industrial truck (PIT) such as inoperable seatbelts and the propane tank toggle clamps on the Hyster Forklift S50 XM, SN# D187V16854X and the Toyota Forklift 8FGU25, SN# 16687.
