29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  On or about December 15, 2022, and at times prior thereto, framers were working around an open floor hole on the third level of a new apartment building under construction without the use of fall protection, exposing the framers to a fall hazard of over 6-feet to the concrete garage below.

29 CFR  1926.502(i)(3): All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees.  On or about December 15, 2022, and at times prior thereto, framers were working around an open floor hole on the third level of a new apartment building under construction without the hole being covered and secured, exposing the framers to a fall hazard of over 6-feet to the concrete garage below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  On or about December 15, 2022, and at times prior thereto, the employer did not provide fall protection training to framers working at heights of 6 feet or higher, exposing the framers to fall hazards.

29 CFR  1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were made without the manufacturer's written approval: Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.  On or about December 15, 2022, and at times prior thereto, framers used a job-made wooden trash box attached to a telescoping forklift without the written approval of the manufacturer, exposing the framers to the hazard of being stuck by falling material or the trash box.
