1926.20(b)(2) The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exist- (a)On or before December 19, 2022, the employer did not ensure that employees who were working in an open-ended trench box that was placed in a 13-ft trench were protected from injury in that an employee was injured after being struck by a 2-ft by 2-ft dirt clod that dislodged near the top-end of the trench. This condition exposed the employees to the hazard of loose material falling into the trench box.
