29 CFR  1910.26(c): The employer did not ensure that portable dockboards  are secured by anchoring them in place or using equipment or devices that prevent the dockboard from moving out of a safe position. If the employer has demonstrated that securing the dockboard is not feasible, the employer did not ensure that there is sufficient contact between the dockboard and the surface to prevent the dockboard from moving out of a safe position.  a) On or about 12/14/2022 at loading dock 8; Employees were exposed to trip/fall and caught in hazards when the employer did not ensure electric dock plate was secured to container while materials were being unloaded.  Employees load/unload materials from freight vehicles such as but not limited to, shipping container.  ABATEMENT CERTIFICATION REQUIRED

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):  a) On or about September 2022, Battery Charging Area; Employees were exposed to fumes when the employer allowed Powered Industrial Vehicle Toyota 5FBCU30, Serial # 60819 to remain in operation with a known defect.  The PIV was unsafe and was not removed from service. Employees use powered industrial vehicles to load/unload materials from freight vehicles.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1910.132(d)(2):The employer did not verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment:  a) On or about 12/21/2022, throughout the facility; employees are required to wear PPE such as steel toe boots/shoes, safety glasses, gloves and hard hats. 29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) On or about 12/21/2022, throughout the facility; the employer did not provide hazard communication program training. Employees were exposed to chemical hazards when performing maintenance and cleaning tasks daily with products such as but not limited to; Lubricants, Uline Multi-purpose cleaner (containing a surfactant blend), Lysol spray (containing ethanol and butane), Comet Powered cleaner (containing limestone and symclosen), Dial Soap.    ABATEMENT CERTIFICATION REQUIRED
