29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level. (a) On or about December 15, 2022, employees erecting a new storage bin and working from a tubular welded scaffold, were exposed to fall a hazard of approximately 10.4 feet to the ground below. (b) On or about December 15, 2022, employees erecting a new storage bin and working from an outrigger scaffold, were exposed to a fall hazard of approximately 16 feet to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a) On or about December 15, 2022, employees, erecting a new bin used scaffolds to perform the work and were not provided with training on the hazards and means/methods to eliminate or minimize those hazards.
