On or about December21, 2022, and at times prior; The employer failed to ensure employees doing roofing operation installing toe board on a residential house was protected from falls of 13 feet 11 inches to ground below due to no fall protection being used.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) 4235 Wilkinson Way. Mobile, Al. On or about December 21, 2022, and at times prior; The employer exposed employees to fall hazard of 13 feet 11 inches to ground in that the employer did not ensure that employees were using the ladder in a safe manor, in that the ladder did not extend 3 feet above the roof eave which exposed employees to fall hazards.
