29 CFR  1910.101(b):The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:  a.) Tim Hortons, DBA Tim Hortons Store #3531, soda station, on or about 12/22/22 and times prior thereto: two compressed gas cylinders of carbon dioxide were free standing and not secured by any device to prevent the cylinders from falling, rolling, or getting knocked over.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

The employer had not developed a written Hazard Communication Program.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Employees were not provided with effective Hazard Communication training pertaining to their specific workplace.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). 29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  A.) Tim Hortons, DBA Tim Hortons Store #3531,on or about 12/22/22 and times prior thereto: employees worked with and around hazardous substances including but not limited to potassium hydroxide, peroxide, and other substances for cleaning and disinfecting purposes.   Safety Data Sheets were not on-site and available for chemicals including but not limited to peroxide.  The site used Material Safety Data Sheets instead of Safety Data Sheets.  In addition the site used old Material Safety Data Sheets.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
