OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from the failure of horizontal support members of industrial steel storage rack. On or about December 15, 2022, at an establishment located 555 West Waukau Avenue, Oshkosh, Wisconsin: employees working in the warehouse were exposed to struck-by hazards related to the instability of horizontal structural steel members of the industrial steel storage racking system used to store Seamex sleeves. These structural members were not resistant to disengagement from forces in an upward direction.

29 CFR 1910.23(e)(2)(i): Steps are uniformly spaced and arranged, with a rise of not more than 10 inches (25 cm) and a depth of not less than 7 inches (18 cm). The slope of the step stringer to which the steps are attached must not be more than 60 degrees, measured from the horizontal; On or about December 15, 2022, at location 555 West Waukau Avenue Oshkosh Wi: the employer failed to ensure that the mobile ladder stand in the warehouse was provided with stairs that were at least seven inches deep.
