1926.503(c)(3)  Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995]  Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:   (a)1 East Franklin Street, New Freedom PA, Building #1, 2nd floor balcony - On or about December 30, 2022, employee(s) working at or near an unguarded balcony opening which was 16 feet above the ground level were not protected with a guardrail system, safety net system, or personal fall arrest system.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):     (a) 1 East Franklin Street, New Freedom PA - On or about December 30, 2022, the employer did not ensure that the employee operating the JLG model G10-55A Telehandler had successfully completed a practical training exercise or received an evaluation of operator performance in the workplace.  (b) 1 East Franklin Street, New Freedom PA - On or about December 30, 2022, the employer did not ensure that the employee operating the JLG model G10-55A Telehandler was certified as having been trained and evaluated to do so.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
