29 CFR 1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: Terry Ludwig Pastels, 12299 Mead Way, Littleton, CO 80125: On or about December 30, 2023, and at times prior, the employer did not assess the exposure of employees who may have been exposed to respirable crystalline silica at or above the action level while manufacturing small batches of chalk using pigments which may contain such potentially hazardous materials including but not limited to quartz. Respirable crystalline silica may cause silicosis. Abatement Note: Abatement certification is required for this item (see enclosed Certificate of Corrective Action Worksheet).

29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Terry Ludwig Pastels, 12299 Mead Way, Littleton, CO 80125: On or about December 30, 2023, and at times prior, the employer did not maintain a written hazard communication program which addressed the criteria in 29 CFR 19200 paragraphs (f), (g), and (h). Employees manufacture small batches of chalk using pigments which may contain such potentially hazardous materials including but not limited to titanium dioxide. Titanium dioxide dust may cause lung fibrosis. Abatement Note: Abatement certification is required for this item (see enclosed Certificate of Corrective Action Worksheet).
